Welcome to VibesWire. These Terms of Service (the “Terms”) govern your access to and use of the VibesWire website, mobile applications, newsletters, and related services (collectively, the “Service”), which are operated by VibesWire (“VibesWire,” “we,” “us,” or “our”). By creating an account, subscribing to a paid plan, or otherwise accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Please read these Terms carefully. They include important information about your legal rights, including a limitation of our liability and the governing law that applies to any disputes.
To use the Service you must be at least 13 years old, or such higher minimum age as may be required by the laws of your jurisdiction. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

VibesWire is an AI-assisted news service. We use artificial intelligence and other automated tools to help summarize, organize, curate, and present news stories drawn from a variety of public sources. Some content delivered through the Service may be generated, summarized, translated, or otherwise transformed by AI systems.
Editorial nature and accuracy. While we strive to deliver useful and timely news, we do not guarantee that the content available through the Service is accurate, complete, current, or free from errors. AI systems can produce inaccurate or misleading output. You should not rely on the Service as a sole source of information for any consequential decision and should verify important information with primary sources before acting on it.
Not professional advice. Content available through the Service is provided for general informational purposes only and does not constitute legal, financial, medical, investment, or other professional advice.
We may add, change, or remove features, content, and functionality at any time, and we may impose limits on certain features or restrict your access to parts or all of the Service without notice or liability.
VibesWire offers both free and paid access to the Service. Some features may be available only to subscribers of paid plans, and we reserve the right to designate certain features as free, paid, or unavailable at any time.
Pricing. The fees for paid subscriptions are described at the point of purchase or on our website. We may change prices at any time. If we change the price of an existing subscription, we will give you advance notice and an opportunity to cancel before the change takes effect.
Billing and renewal. Paid subscriptions are billed on a recurring basis (for example, monthly or annually) using the payment method you provide. By subscribing, you authorize us, or our third-party payment processor, to charge that payment method on each renewal date until you cancel. You are responsible for keeping your billing information current.
Cancellation. You may cancel a paid subscription at any time through your account settings. Cancellation will take effect at the end of the then-current billing period; you will continue to have access to the paid features through that date and will not be charged again unless you resubscribe.
Taxes. Fees are exclusive of any applicable taxes, levies, or duties unless stated otherwise. You are responsible for any such amounts associated with your subscription.
Except where required by applicable law, all fees paid for the Service are non-refundable. We do not provide refunds or credits for partially used billing periods, unused features, or downgrades.
At our sole discretion, we may issue a refund in limited circumstances, such as a duplicate charge, a billing error attributable to us, or where we are otherwise unable to provide the paid features you have purchased. To request a refund, contact us at the address below within thirty (30) days of the charge in question and include your account email and a brief description of the issue.
If applicable law in your jurisdiction grants you a statutory right to a refund or to withdraw from the contract, that right is not affected by this section.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree that you will not, and will not attempt to:

Our content. The Service, including its software, design, text, graphics, logos, and all content we create or curate, is owned by VibesWire or our licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms.
Third-party content. The Service may include or link to articles, headlines, excerpts, images, or other materials owned by third parties. Those materials remain the property of their respective owners and may be subject to additional terms imposed by them. Nothing in these Terms transfers any ownership of third-party content to you.
Trademarks.“VibesWire” and the VibesWire logo are trademarks of VibesWire. You may not use them without our prior written permission.
Feedback. If you choose to send us suggestions, ideas, or feedback about the Service, you grant us a worldwide, royalty-free, perpetual, irrevocable license to use that feedback for any purpose without obligation to you.
We respect the intellectual property rights of others. If you believe that material accessible through the Service infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to our designated agent at the contact address below. Your notice should include the information required by 17 U.S.C. § 512(c)(3), including identification of the copyrighted work, identification of the allegedly infringing material and its location, your contact information, a statement of good-faith belief that the use is unauthorized, a statement under penalty of perjury that the information is accurate and that you are authorized to act, and your physical or electronic signature.
We may, in appropriate circumstances and at our discretion, remove or disable access to allegedly infringing material and terminate the accounts of repeat infringers.
The Service may contain links to or integrations with third-party websites, products, or services that we do not own or control. We provide these links and integrations for convenience and do not endorse and are not responsible for the content, policies, or practices of any third party. Your use of any third-party site or service is at your own risk and may be subject to that third party's separate terms and privacy policies.

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by applicable law, VibesWire and its affiliates, officers, employees, agents, and licensors disclaim all warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising out of course of dealing or usage of trade.
Without limiting the foregoing, we do not warrant that the Service will be uninterrupted, secure, or error-free; that defects will be corrected; that the Service or the servers that make it available are free of viruses or other harmful components; or that any content, including content produced or summarized by AI, is accurate, complete, current, reliable, or suitable for your purposes.
Some jurisdictions do not allow the exclusion of certain warranties. To the extent any such warranties cannot be excluded under applicable law, the disclaimers in this section apply to the fullest extent permitted.
To the fullest extent permitted by applicable law, in no event will VibesWire or its affiliates, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your access to or use of, or your inability to access or use, the Service, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not we have been informed of the possibility of such damage.
To the fullest extent permitted by applicable law, our total cumulative liability arising out of or related to these Terms or the Service will not exceed the greater of (a) the total amounts you paid to VibesWire for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
The limitations in this section apply even if a remedy fails of its essential purpose. Some jurisdictions do not allow the limitation of certain damages, so some of these limitations may not apply to you.
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless VibesWire and its affiliates, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; or (c) your violation of any law or third-party right.
You may stop using the Service at any time and may close your account through your account settings. We may suspend or terminate your access to all or part of the Service at any time, with or without cause and with or without notice, including if we believe you have violated these Terms or if we discontinue the Service.
Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination, including those addressing intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution, will survive.
We may update these Terms from time to time. If we make material changes, we will notify you, for example by posting a notice on the Service or by sending you an email. The updated Terms will be effective as of the date indicated at the top of this document. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Service.
These Terms and any dispute arising out of or related to these Terms or the Service will be governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Subject to the dispute resolution provisions below, you and VibesWire agree that the state and federal courts located in Texas will have exclusive jurisdiction over any dispute, claim, or controversy arising out of or related to these Terms or the Service, and you consent to the personal jurisdiction of those courts.
Informal resolution. Before filing any claim, you agree to first contact us at the address below and to attempt in good faith to resolve the dispute informally for at least sixty (60) days.
Time limit. To the extent permitted by applicable law, any claim arising out of or related to these Terms or the Service must be filed within one (1) year after the cause of action accrues, or it will be permanently barred.
Entire agreement. These Terms, together with any other policies referenced here (such as the Privacy Policy), constitute the entire agreement between you and VibesWire regarding the Service and supersede any prior agreements between us regarding the Service.
Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.
No waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law.
Notices. We may provide notices to you by email, by posting on the Service, or by other reasonable means. You may provide notices to us at the contact address below.
Force majeure. We will not be liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, war, terrorism, riots, labor disputes, internet outages, or governmental actions.
